As you know U.S. Secretary of Education Arne Duncan has outlined a series of new regulations that the Obama Administration says states must have in place in order to apply for the RTTT grants. These regulations are more of the one-size-fits-all approach of the No Child Left Behind Act that has failed students and schools for the last several years. Duncan has attacked California's statewide data system without understanding how our current law works and the role of local collective bargaining. The new regulations also mandate using student test scores as a "significant factor" in evaluating and paying teachers, overhauling California's content standards and creating a new testing system, and encouraging charter schools to be the number one solution for turning around lower-performing schools. Keep in mind that the federal guidelines are in the draft phase and are not even scheduled to be finalized until October. CTA has been very vocal about these regulations for weeks. We released a statement immediately in response to the special session and the governor's attempt to quickly push through sweeping education reform, and pointed out that voters decided overwhelmingly against similar reforms he proposed in 2005. Our Governmental Relations department has launched an aggressive legislative and congressional lobbying effort through our legislative and congressional contacts. Senator Gloria Romero has called a legislative hearing for next Wednesday, August 26 at which CTA will provide testimony. CTA and NEA are submitting comments to Secretary Duncan about the regulations, and we are working with other members of the Education Coalition to unify our responses and opposition. In addition, we've created an online section for RTTT on www.cta.org that will continue to grow in the coming days and weeks. Information in the bulleted list below is already available there.

Find out more here http://bit.ly/2mSGJ Call Governor, Lawmakers: Urge Them to Approve Budget Compromise that Protects ’98 (Budget Call for Action Phase 3)A new CTA Call for Action is urging our members to get in touch with the governor and their state lawmakers in support of the new budget compromise that will protect Proposition 98 and restore nearly $11.3 billion to public education in coming years. Message from CTA President, David Sanchez The “Governator” is at it again. Well, enough is enough! We will not tolerate the governor’s latest attack on Proposition 98, our schools and our students. Tomorrow, CTA will launch a major TV ad campaign blasting Gov. Schwarzenegger’s latest attempt to suspend Prop. 98 – California’s minimum school-funding law – and rob millions of dollars from public schools. The ad, which will appear in the five major state media markets, urges Californians to call the governor and tell him to protect our schools. This TV ad launches on the heels of 10,000 postcards that were delivered this past Monday to the governor at his San Diego office by CTA delegates attending the NEA RA. The media coverage was great. Be sure to check out the photos of the event on the CTA website. I’m asking that you continue to urge your colleagues to call and e-mail the governor and legislators to tell them to leave Prop. 98 alone. In order to make sure the governor hears from our members, we will be starting patch-through calls between our members and the governor on Friday. Quick Links: Rather than punishing schools, it’s time for our politicians to repeal the corporate tax breaks handed out to big business and tax oil production, like every other state. Sanchez CTA President August 15th (RIF) Reduction in Force United Teachers of Pasadena was recently notified that the Pasadena Unified School District plans on increasing class sizes thereby necessitating an August 15th RIF. The administration will present a Resolution at the Tuesday, June 23rd Board of Education Meeting. The Resolution will identify the number of FTE’s (Full Time Equivalents) and the PKS’s (Particular Kinds of Services) to be laid off. No names are specified in the Resolution. Upon Board approval, the Resolution will be the basis for the District to issue preliminary layoff notices using the seniority list to determine which employees will receive RIF notices. The final layoff notices will be issued no later than August 14, 2009. Any employee who receives a RIF notice will be entitled to a Hearing in front of an Administrative Law Judge. UTP/CTA will provide an attorney to represent its members during the Hearing. UTP leadership received the following notification of the number of FTE’s and PKS’s that will receive preliminary lay off notices: 34 FTE’s with a Multiple Subject Credential 5 FTE’s with an English Credential 6 FTE’s with a Social Studies Credential 2 FTE’s with a Physical Education Credential A possibly small unknown number of math teachers We estimate that during this round of layoffs, the District plans on reaching into our 3rd year permanent teachers who were considered 1st year probationary employees during the 05-06 school years. You should have received a Summer Contact Sheet form from UTP/CTA/NEA from your site representative to fill out. We hope that you turned it in to them so that we may be able to keep you informed. If you have any questions, we suggest you speak to and keep in contact with your elected school site representatives (via email lists or phone trees) because they will have received the latest updates from your UTP President. The UTP Office will disseminate any and all information as it becomes available to your school site representatives – who are your conduits to the information. If you have a question about your seniority, you must contact the District because they are your employer. We do not have the latest and most updated seniority list that would provide us with enough information to make an accurate prediction of your potential layoff. When they provide us with the list, we will be sure to go through it and verify any inaccuracies or errors and provide it to UTP members as necessary to ensure the layoff procedures and seniority lists were handled properly.
Some background information on where this August 15th layoff information may be coming from: The District has been increasingly seeking out legal counsel and hired the law firm, Miller, Brown, and Dannis to represent them at the bargaining table. This is the same firm used by Los Angles Unified. See what United Teachers of Los Angeles has to say about them here. Greg Dannis, the negotiator for the both Districts recently wrote an article entitled “The “Secret” Certificated Layoff Process” for School Services of California, Inc., who claims to be “Public Education’s Point of Reference for Marketing Educated Decisions.” This article talks about the secret ways of laying teachers off. We have to question why the District Administration is choosing to go the route of using a firm who clearly has a vested interest in ensuring that they can keep their firm profitable with tax payer money by pursing lengthy legal layoffs. Why not do all the layoffs in March? Layoffs in March equals billable hours, more layoffs in August equals even more billable hours. It may be interesting to know that the August 15th layoffs have only been used once in the State of California and it was up in the Bay Area where the law firm Miller, Brown, and Dannis is located. Is this a coincidence? It is unfortunate that this PUSD Administration may cause PUSD to be the second district in the State to conduct August 15th layoffs, thereby being pioneers to head the PUSD in the wrong direction.
